Kelly S. Brush Foundation, Inc. (“we” or “KBF”) is a non-profit corporation dedicated to making active lifestyles a reality for those who have experienced a spinal cord injury. To that end, we collect and use information to provide you with a better experience and fulfill our mission.
We value your privacy. This Privacy Notice (“Notice”) describes the types of personal information we collect or obtain, the reasons why we collect or obtain this information, how we may use the information, with whom we may share this information, how we safeguard this information, and more. We will not collect, obtain, use, or share personal information except as described in this Notice, unless you consent.
We encourage you to read this Notice carefully so you can understand our policies and practices regarding your personal information. Please also note that by choosing to access or use our website or submitting a grant, scholarship, camp or other application online, you agree to these policies and practices. If you do not agree, you may choose not to access our website or access our online community.
We may change this Notice periodically (see “Changes to this Notice,” below). You agree to any changes we make if you continue to access our website or use our services after we make the changes, so please be sure to check this Notice periodically for any updates.
1. How We Collect or Obtain Information
We collect or obtain several types information in the following ways, depending on your use of our website or services:
- We collect information from you directly, such as when you communicate with us via our website, phone, email, or in person for purposes of applying for a grant, making a donation, subscribing to our newsletter, etc.
- We may collect information from your treating physician, primary care provider, or hospital, with your permission, regarding or relating to your spinal cord injury.
- We may collect information from personal recommendations provided by a coach, adaptive sports program instructor, teacher, family member, friend, or peer you have been or plan to be active with.
- We collect information automatically about your use of our services and about users of website, including the devices you use to access our services, using cookies and similar technologies for this purpose (see “Cookies and Other Tracking,” below).
- We may collect information from or through third parties, such as service providers (e.g., Survey Monkey, Raisin, Signup.com, Square, Donor Perfect, Constant Contact), third-party applications, and devices that you use to connect to our services.
- We may collect information that you choose to make publicly available, such as on social media.
2. Information We Collect or Obtain
The categories of information we may collect through your use of our website may include the following:
- Identifying and contact information including name, email address, phone number, gender, age, birthdate, preferred pronouns, street address, account password, and any additional information you choose to share with us.
- Social media information including Facebook name, Twitter handle, Instagram handle, etc.
- Financial information, such as payment information (e.g., credit card).
- Any other information you choose to provide to us about yourself, such as content in an e-mail, your volunteer interests, etc.
- Technical information about your browser, device, etc.
We collect this information in order to coordinate, carry out, and assist you with our services, provide you information about our mission, help you donate or volunteer, and communicate with you regarding our ongoing projects as well as our grants, camps, and events.
In addition to the information listed above, we also may collect the following categories of information from our grant or camp applicants:
- More detailed personal information such as how you describe yourself, information about your family, and reasons for submitting an application.
- Information about the cause and nature of your injury.
- Photos or videos of you being active or doing everyday things to explain your story to us.
- The type and model of equipment you are applying for and how you plan to use that equipment.
- Your experiences with sports, activities, and other equipment.
- Information about how much grant funding is being requested.
- Financial information, which may include:
- Household income.
- Federal tax returns.
- Social Security Income benefit verification letters.
- Information about forms of income or access to funds (family support, annuities, other structured payments).
- Previous grant information from KBF or elsewhere.
- Information about your previous use or desire for use of adaptive sports equipment.
We collect this information for the purposes of reviewing, assessing, and acting on grant or camp applications.
3. Why We Collect, and How We Use, Your Information
We collect and use the information described above for a variety of important purposes:
- To achieve our mission of empowering you to grow and be active.
- To help fund your best active lifestyle through grants.
- To connect you with others in the spinal cord injury community.
- To communicate and coordinate with you regarding our community events, grant applications, camps, and other activities.
- To market our projects, services, and capabilities.
- To operate, maintain, and complete services at your request.
- For the purposes described below under “Cookies and Other Tracking”.
- For the purposes described below under “Sharing and Disclosure of Your Information”.
4. Cookies and Other Tracking
When you use our website, we collect information from you by automatic means, including cookies and pixel tags. These are small text or electronic files (some of which may be placed on our website user’s device or browser) that allow us to improve content and consumer experience, recognize and remember things about users, count users who have visited our website, determine how they got here, track their activity on the website, gauge their interests, gather technical information about their devices, browsers, IP addresses, etc., assess our website’s performance, and help protect our sites against certain attacks. The cookies used on our website also may identify other devices you use to visit our website, which helps us to ensure that our site functions correctly for any device you may be using.
Our website currently uses cookies that are provided or placed by the following:

- Constant Contact
- HubSpot
We use information from cookies for analytics, user experience improvements, and marketing purposes.
Please also note that our website is not designed to respond to “do not track” signals or similar requests from browsers.
5. Sharing and Disclosure of Your Information
The information we collect and/or obtain about you when you use our website (see “Information We Collect or Obtain” above), along with any inferences we may draw from that information, may be shared with the following third parties in the course of providing our services, administering our programs, and enhancing and fostering the spinal cord injury community:
- KBF committee members engaged in the review of applications.
- Third parties such as vendors and other service providers assisting us or working on our behalf.
- Other parties as necessary for our promotion of active lifestyles for those who have experienced a spinal cord injury.
In addition, we may share your information with other third parties at your direction or upon your consent.
As explained in the “Cookies and Other Tracking” section above, we also share information with Google, Constant Contact, Facebook, and HubSpot for marketing and analytics purposes.
We also may disclose information about you if necessary to comply with applicable laws and regulations; to respond to any legal process or other lawful request for information we receive; to protect vital interests of you or another natural person; to detect, prevent, and investigate fraud, abuse, or other illegal activity; to defend our legal interests where necessary for our legitimate interests or the legitimate interests of others; or to otherwise protect our rights. We may transfer personal information we have about you in the event we sell or transfer some or all of our business or assets.
6. Notice Regarding Children’s Privacy
We do not knowingly or intentionally request, collect, use, or share personal information directly from children under 13 years of age without the consent of their parents or guardians. However, we recognize and appreciate that our grant, scholarship and camp applicants include children under 13 and that children under 13 have the ability to share information with us through our website (such as by signing up for our newsletter). Our hope and intention is that any information collection regarding children under 13 will occur only with the knowledge and consent of the child’s parent or guardian. If we discover or are notified that we have received information from a child under 13 without the necessary consent as required by applicable law, we will immediately delete the information from our servers and instruct any third parties with whom we have shared the information to do so as well.
7. Access, Correction, and Deletion of Your Information
To learn what personal information we have about you, or to update, correct, receive, or delete that information, please contact us as indicated in the “How To Contact Us” section below. Please note that under certain circumstances we may not be able to honor requests to delete certain information.
We also reserve the right to verify your identity before responding to a request, which may include, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, email address, phone number, or other information.
8. Opt-Out of Communications
If you do not wish to receive emails or other communications from us, please let us know by contacting us as indicated in the “How To Contact Us” section below. You can also unsubscribe following the instructions at the bottom of our emails.
9. Protection of Your Information
We maintain reasonable safeguards in order to protect your personal information from accidental or unauthorized access, use, disclosure, alteration, destruction, or loss. These safeguards include technological measures such as encryption, multi-factor authentication, and password protection; administrative measures such as information access limitations, employee training, periodic risk assessments, auditing, and contractual obligations for third parties to retain confidentiality; and physical measures such as access restrictions. We also use only vetted enterprise companies to assist with our services.

We may update this Privacy Notice from time to time in order to reflect changes to our practices or for other operational, legal, or regulatory reasons. Whenever we make any changes to this Notice, we will update the “Last Updated” date above. We encourage you to check our Privacy Notice often to always be up-to-date on the current version and to review any updates we have made.
